In this document, the following words “we” or “us” or “our” or “Strapoint” are used interchangeably to refer to Strapoint Ltd and “user”, “users” or “you” are used interchangeably to refer to our customers.“Straps” means points implying the number of accrued points from a merchant.
1.0 Responsible use
You hereby agree to provide your email address as part of the registration process in order to have full access to Strapoint Service. The information you have provided would be stored securely to industry standard and will be used for the purposes of providing you with relevant discounts and promotional offers for goods and services or relevant information that we think might be of interest to you. You reserve the right to unsubscribe from these services at any time. By providing your email address, you consent to receiving messages about promotional offers from us. If you are providing information on behalf of another person, please ensure you have their consent before doing so and also inform them of how we might use their data.
2.0 Right of refusal
2.1 We reserve the right to make changes to our terms at any time. Should there be any modification to our terms, we would endeavour to notify you with the email address you provided during registration.
2.2 We reserve the right to terminate your access to our service(s) without prior notice should there be evidence beyond reasonable doubts that you are abusing your privileges.
3.0 Contractual Obligations
Your contractual obligation for points and rewards is NOT with Strapoint but with the respective merchants. As such, we cannot be held responsible for failure of any merchant to exchange your straps for rewards.
4.0 Liability and Indemnity
4.1 By using our Service, you consent not to assert any claims or allegations of any nature whatsoever against Strapoint, or any business partners. This also means that you will not claim or allege an infringement of proprietary rights, any inaccuracy of the Service, or allegations that any person or entity has or should protect you from any claim or allegation arising from your use or other exploitation of the Service. You use the Service at your own risk. Without limitation of the foregoing, we will not be liable for any direct, special, indirect or consequential damages, or any other damages of any kind, including but not limited to loss of opportunity, loss of profits or loss of data, whether in an action in contract, tort (including but not limited to negligence) or otherwise, arising out of or in any way connected with the use of the Service, including without limitation any damages caused by or resulting from your reliance on the Service or information accessible via the Service, or that result from mistakes, errors, omissions, interruptions, deletion of files or email, defects, viruses, delays in operation or transmission or any failure of performance, whether or not resulting from acts of god, communications failure, theft, destruction or unauthorised access to the Service and all warranties, guarantees, conditions or other terms implied by statute, common law, trade usage or otherwise are excluded to the fullest extent permitted by law. In no event shall the aggregate liability of Strapoint, whether in contract, warranty, tort (including negligence, whether active, passive or imputed), product liability, strict liability or other theory, arising out of or relating to the use of the Service exceed the cumulative sum paid by you for access to or use of the Service during the three months prior to the date of any claim. You shall defend, indemnify and hold harmless Strapoint and the other persons referred to before from any loss, damages, liabilities, costs, expenses, claims and proceedings arising out of your use of the Service, including any claims made by any person that any information you have provided to Strapoint damages their reputation or defames them or infringes the rights, including the intellectual property rights, of any third party.
5.0 Fair Usage
The app and your account is for the exclusive use of the account holder whose details we hold on our record. At no point should you share or transfer the usage of your account privilege with a proxy. This is unacceptable and would be a breach of your privilege which could lead to your account being terminated.
